Terms of Use

These Terms of Use ("Terms") govern your use of the Spatial Tracks app ("Spatial Tracks," "the app"), made by DMK Studios. By downloading or using Spatial Tracks, you agree to these Terms.

1. Requirements

Spatial Tracks requires an Apple Vision Pro and a valid Apple ID. Most experiences play using an active Apple Music subscription; External Audio Mode allows you to use the app with your own audio source instead, without a subscription. Some features depend on services provided by Apple that are outside our control.

2. License

Subject to these Terms and Apple's Standard End User License Agreement (EULA), we grant you a limited, non-exclusive, non-transferable license to use Spatial Tracks on Apple Vision Pro devices you own or control, for your personal, non-commercial use.

3. In-App Purchases

Spatial Tracks includes a set of tracks available at no additional cost, plus additional tracks available for purchase through the Spatial Tracks Store. All purchases are processed by Apple through the App Store and are billed to your Apple ID. Purchases are one-time and unlock the corresponding experience permanently on your account, subject to Apple's platform policies. Refund requests are handled by Apple — visit reportaproblem.apple.com to request one.

4. Acceptable Use

You agree not to reverse engineer, redistribute, resell, or extract audio or visual content from Spatial Tracks, and not to use the app in any way that violates applicable law or infringes the rights of others.

5. Content & Intellectual Property

The spatial environments, visual designs, and software in Spatial Tracks are original creative works owned by DMK Studios. Music streamed through the app via Apple Music remains the property of its respective rights holders and is licensed to you only through your own Apple Music subscription — not by us. Spatial Tracks does not grant any rights to the underlying musical works beyond what your Apple Music subscription already provides.

6. Disclaimer of Warranties

Spatial Tracks is provided "as is" without warranties of any kind, express or implied. We do not guarantee uninterrupted or error-free operation, particularly where functionality depends on third-party services such as Apple Music.

7. Limitation of Liability

To the fullest extent permitted by law, DMK Studios is not liable for any indirect, incidental, or consequential damages arising from your use of Spatial Tracks.

8. Termination

We may suspend or discontinue any part of Spatial Tracks at any time. You may stop using the app at any time by deleting it from your device.

9. Changes to These Terms

We may update these Terms from time to time. Continued use of Spatial Tracks after changes take effect constitutes acceptance of the revised Terms.

10. Governing Law

These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict-of-law principles.
